As of January 1st, 2017 the doctors and health care providers covered under Affordable Care Act (aka pretty much all of them) are allowed to refuse service to any transgender or woman who has had a past abortion citing “religious freedom” for the reason.
The ACA was set up to not discriminate in any way to any patient, kind of the reason it was set up considering the US is killing it in the discrimination game these days. District Court Judge Reed O’Connor’s ruling is the first step in pulling apart this Act. Using the Church Amendment which forbids requiring any individual “to perform or assist in the performance of any part of a health service program . . . if his performance or assistance in the performance of such part of such program . . . would be contrary to his religious beliefs or moral convictions.”and the Burwell vs Hobby Lobby case which ruled any private corporation or family owned business has the right to refuse birth control and abortions under their coverage if it goes against the owners beliefs, he ruled that any doctor can refuse service if it will impose a burden, cause emotion damage, or morally damage them and their religious beliefs.
Not to be biased, but isn’t the point of a doctor to take care of us, save us, fix us? I fully believe in religious freedom and believing in whatever power, or non, that brings happiness and hope to your life but when you become a doctor or medical provider you take an oath to do no harm to any individual.
This Rule is one for the books. Not only does it interfere with the entirety of ACA but also opens the door to future rulings allowing religion and other factors to stop service and save lives. Looks like America just added to the bill of things we are discriminating about. Can we get the damn check already?
